Terms & Conditions
1. Scope
These Terms & Conditions apply to all contracts, services, and offers provided by Oblik3D – Owner Angela Cvetkovic, unless otherwise agreed in writing. Conflicting terms of the client are only valid if expressly acknowledged by Oblik3D in writing.
2. Services
Oblik3D provides services in 3D visualization, animation, virtual tours, web development, and marketing support. The specific scope of work is defined in the individual offer.
3. Project Process & Client Obligations
- Project Materials: The client must provide complete project documentation (CAD files, references, etc.) in due time.
- Feedback: Feedback must be submitted in writing within 1–2 business days of receiving drafts.
- Revisions: The agreed price includes up to three (3) revisions per project phase. Additional iterations will be charged separately.
4. Intellectual Property & Usage Rights
- Source Files: Oblik3D retains ownership of all raw project files (3D models, scenes, textures).
- License: The client receives a non-transferable license to use the final deliverables exclusively for the agreed project purpose.
- Restrictions: Resale, distribution, or modification of deliverables without written consent is prohibited.
- Portfolio Rights: Oblik3D may use final deliverables for marketing and portfolio purposes. Upon written request, anonymized presentation can be agreed.
- Credit: The client agrees to credit Oblik3D as the provider unless otherwise agreed in writing.
5. Delivery & Formats
Deliverables are provided only in the final formats specified in the offer (e.g., JPG/PNG). Raw files will only be supplied if separately agreed and compensated.
6. Pricing & Payment Terms
- All prices are net plus applicable VAT.
- Payments must be made within the deadline stated on the invoice.
- Late payments incur interest at 5% above the base interest rate. Oblik3D reserves the right to suspend work until payment is received.
- Usage rights are transferred only after full payment.
7. Changes & Additional Services
Any services beyond the agreed scope (e.g., additional visuals, concept changes) will be charged separately and require prior approval.
8. Project Interruption & Cancellation
- If the client interrupts or cancels the project, all work completed to date must be paid in full.
- For extended interruptions, Oblik3D reserves the right to recalculate timelines, scope, and costs.
9. Confidentiality
Both parties agree to keep all project-related confidential information strictly confidential and use it solely for project execution.
10. Force Majeure
Oblik3D is not liable for delays or non-performance caused by events beyond its control, including natural disasters, infrastructure failures, or illness.
11. Liability
Oblik3D is liable only for intent and gross negligence. For slight negligence, liability is limited to breaches of essential contractual obligations. Liability for indirect damages or loss of profit is excluded.
12. Final Provisions
- German law applies.
- Place of jurisdiction is Berlin, as far as legally permissible.
- In case of discrepancies between the German and English versions, the German version shall prevail.
- If any provision is invalid, the remaining provisions remain in full force.
